盧委員縣一：次長好。我們今天談了很多，不過對於今天的修法，本席是希望能夠留下三件事情：第一是司法、社政、教育之間的資訊不能斷鏈；第二是被害人的權利不能因為他太晚、沒有勇氣說出口，就被時效關在門外；第三是高風險加害人的處遇與社區監督不能有空窗，而第一線也要有足夠的人力跟預算去執行。講到所謂的空窗，我們修這些法律就是看能不能真正的降低風險，所以今天討論的加害人登記、報到、查訪、身心治療、輔導教育及高風險資訊的揭露，看起來像是不同的制度，但其實都是在處理同一件事情，就是社區的監督不能出現空窗，風險也不能在再次發生傷害之後才被看見。所以我想知道次長看見的處遇空窗大概發生在哪兩個類型？ |

盧委員縣一：處遇空窗我爬梳了一下，大概知道是在易科罰金的部分及被移送偵辦的時候會出現處遇空窗。現行法令已經規定有期徒刑如果准予易服社會勞動者，不必等到刑期執行完畢，在准予易服社會勞動時就可以啟動身心治療跟輔導教育等評估處境，可是沒有入監執行的易科罰金，在現行條文中並沒有相同的規定，所以我想說易科罰金跟移送偵辦的時候，是不是他的處遇起點也應該要有這樣的修法方向？你們有沒有同意、支持這個修法方向？ |

盧委員縣一：好，再來就是有關加害人的資訊揭露，有委員的版本已經採取分級制度，就是不是所有的加害人一律公開，揭露的資訊也不是毫無限制。可是要討論的是，面對經專業評估認定有再犯風險的個案，我們能不能依照比例原則，採取分級、分對象、分區域、分期間的必要通知？第二個，對於評估具有什麼級別以上的再犯風險，經常活動在學校、幼兒園或托育機構附近的個案，是否可以研議向特定學校機構一定範圍內做必要對象的通知？ |

呂次長建德：跟委員報告，現在就是兩個問題，第一個就是大家都非常關心性侵害案件的加害人要不要資訊公開，我們剛剛跟黃秀芳委員的答詢中也有提到，因為很多加害人事實上都是熟人，所以會怕的是被害人會不會因為這樣的資訊揭露而被人家按圖索驥，甚至是公審，造成二度傷害，所以這個真的必須要謹慎為之，這是第一點。 |

第二點，剛剛委員所說的，有關於風險的分級，其實現行的性侵害防制法裡面就有部分公告，如果認為有再犯之虞的話，我們的法院事實上就可以有強制治療跟社區隔離的作為，如果還有再犯風險，卻沒有按照規定強制治療，甚至有逃亡、藏匿之虞的話，警察機關在這種情況之下，可以公告他的身分資訊，包括他的姓名、照片跟所犯罪名，所以這裡面我們都有整個分級的相關設計。 |

盧委員縣一：昨天三讀通過了兒少及家庭支持署組織法，在兒童及少年性剝削防制條例第三條明文規定「主管機關應獨立編列預算，並置專職人員辦理兒童及少年性剝削防制業務。」所以本席想請問，衛福部是否掌握了全國22個縣市各自編列多少兒少性剝削的防制預算？有沒有預計會核定多少專職人員、實際到職的有多少？有多少名義上是專職人員，可是實際上還是兼辦家暴、兒保、性侵害及其他社政案件？我想知道目前每名人員平均負擔多少案件？所以我有一個具體訴求，希望衛福部能夠在一個月內，向本委員會提出22縣市的盤點報告，至少應該包括兒少性剝削的獨立預算、中央補助與地方自籌的經費、核定及實際到職專職人力缺額跟兼辦的情形、平均案量及本次修法新增業務所需要的人力跟經費評估。 |

呂次長建德：非常感謝委員的關心，完全支持委員，也非常感謝委員對於我們保護性社工的支持。跟委員報告，牽涉到地方政府有關於性剝削的部分，如果沒有記錯，大概56位，詳細數字我再跟您回報。在這裡面，其實我們也知道，他的caseloading、案件的負擔量其實真的蠻大，所以也非常感謝委員的支持，我們也會趕快請人總把相關人力予以補足。至於委員剛剛所垂詢的相關數字，是不是容許我會後再趕快提供給委員參酌？ |

盧委員縣一：好，謝謝。今年7月刑法第八十條已經修正公布，針對特定未成年性侵害案件，法律明定被害人滿二十歲以前不計入刑事追訴權時效期間，可是最主要的是民法在這部分好像沒有一併修正，所以我想請問次長，對於這個部分是不是也支持現行15年的客觀期間限制，還是另外延長時效，至少比照刑法修法的精神，被害人未成年的期間不計入，等到他具備一定自主能力後才開始計算民事求償的部分？ |

盧委員縣一：最後就是資訊斷鏈的部分如何補齊，針對第三十二條之一，在野黨跟執政黨的委員都有提出，認為不能再讓司法歸司法、社政歸社政、教育歸教育，然後最後每一個機關手上都是一小塊資訊，沒有人看到完整的風險。所以本席想請教次長，對於偵查中必要取得資訊，以及起訴後司法資訊主動銜接主管機關這兩件事情，衛福部是不是支持這樣的制度化？ |
