我有另外一個問題要就教次長，老師面臨濫訴、霸凌、被調查的恐懼，身心俱疲到離場，甚至成為社會事件，這類狀況頻頻發生，也衝擊教育與學生的受教品質，所以我們現在推動改革來守護教權。6月24號我質詢您的時候，您當場允諾我會朝專章或專法來保障教權，並在一個月內研議做出評估報告，我當時還對您表示肯定。我想請教次長，7月28號我收到教育部的函文，你知道上面寫什麼嗎？我收到你們的函文，因為一個月內你們要給我函文，你給我的回答是什麼，你知道嗎？我告訴你，考量現行法令規定已有明確規範，提供教師權益保障及申訴相關措施，暫不另訂教師法增設教權專章或制定教權保護專法。我放一段影片來看次長在之前的質詢是怎麼說的。 |

羅委員智強：次長，沒有關係，我跟你講，第一個，我為什麼講我剛剛笑得有點尷尬，因為當時我得到的資訊不是這樣，但沒關係，你要有改變，可是我還是要跟你說，事實上，老師反映再反映，委員也拜託再拜託，在教育部眼中，我覺得老師的意見好像不被重視。日韓2022年就開始修教權專法，讓問題減緩，我們現在卻連開始都不願意，你一度願意從專章做，我也沒有堅持專法，你有專章，我覺得先從專章開始，結果現在連開始都不願意開始。在6月我的質詢其實說得很清楚，我引述日本跟韓國在2020年做的法制改革，提出設置學校律師以及修法，以法律層級明定保護教權，韓國有修訂教權四法，其中教師地位提升與教育活動保護特別法，增訂侵害教育活動的定義，如果高中以下學校或其監護人對教師、教育實施不公正干涉或限制，包括不正當目的反覆投訴，不斷強迫教師進行不屬於法定職責的工作等等，都是侵害教育活動。日韓也有霸凌濫訴的問題，他們都在2020年開始從事法律設計、制度改革來漸漸減緩教權不彰並改善教育現場，所以我才鄭重拜託部長，也請教次長，能夠對於其他國家的立法例……因為你也知道教權不彰、老師被霸凌濫訴的情形其實不是臺灣獨有，日本、韓國也很嚴重，所以我們今天要解決我們的問題當然要跟其他的國家來參照，結果現在你自己承諾的專章，現在又跟我講說你們覺得不需要…… |

羅委員智強：我要告訴您，拜託你們再好好研議一下，當初你這樣子答應我，我不認為你是隨性的，你自己一定有研究，這個問題那麼嚴重，我不相信你沒有研究其他國家比如日韓的體例，所以你上來答詢的時候，你一定是經過研究，當時你覺得可以做，否則你幹嘛當初那麼篤定告訴並答應我呢？我還是要講，今天在這邊，這件事我也會繼續來追蹤，我還是拜託次長跟教育部，老師的問題真的很嚴重，比方人家日本各都道府縣的教育委員會都配置學校律師，對學校面臨的問題提供法律質詢，日本的政府統計2022年最多諮詢的內容就是家長的過度抱怨跟無理要求，所以日本政府2020年就開始撥預算支持這個措施。時間的因素，我還是拜託次長，你回頭想一想，教育部再審慎研議一下，以上。 |
