林委員岱樺：署長，將近3個月前我針對EZ WAY第一次質詢，今天再進行第二次的質詢。人民跨境網購的時後，我們的EZ WAY能不能做到事先告知購買的物品是否會觸及相關檢疫法規或是衛福部的衛生相關法規？我希望民眾能夠事先知情，不知道現在的進度如何？ |

彭署長英偉：跟委員回報，上次委員質詢後關務署立即做兩件事：第一，因為在邊境管制上有一些輸出入規定或需經許可的，這些都是屬於邊境其他輸出入主管機關，即所謂簽審機關的規定，我們立即與這些機關聯繫，請他們依照委員的意思，將需要提醒民眾的項目告知。我們做的第二件事情就是跟關貿網路公司聯繫，就是日後要依委員的指示，在民眾上網購物時需要有一個提示的功能。目前兩項我們都已經在處理了，簽審機關已回復，以後大概有兩百七十幾項的項目會提醒民眾。 |

林委員岱樺：好，你們將EZ WAY委給關貿網路公司，你認為到底EZ WAY這樣的通關便利程序，是不是屬於財政部下的通關法定程序呢？ |

彭署長英偉：跟委員回報，我們的通關程序指的是跟海關遞送報單等等，而民眾要不要委託報關行處理報關的事情，我們一向認為民眾與報關行之間的委任關係並不是通關行為。 |

林委員岱樺：好，所以你認為EZ WAY對人民收費，不管是對報關業者、承攬業者，以及這些業者轉嫁給所有消費者，這些都是民間的事務，跟你沒有關係。那本席要質疑了，第一個，你為了讓EZ WAY通關便利，今年2月修改法令，讓它要求大家網購時一律要用EZ WAY，因為現在沒有按下EZ WAY委任確認，網購就不能進來。誰？民間哪一個資訊業者可以有這樣的權力？政府給他賦權了。第二個，有關API的介接，誰有能力可以有API的介接？你們給予關貿公司權力，一般民間的資訊公司可不可以？沒有！你沒給它這個權力。既然我沒有按下委任確認就不能通關，哇！這茲事體大，是你們授權給它，但是你還認定EZ WAY是民間的，對此本席不能認同。 |

我不能認同的原因是因為它亂收費，它現在收了兩筆，雖然你說這些都不是消費者，但不管是報關業者、承攬業者，全部都轉嫁給消費者喔！第一筆，購物後必須有一項確認費，每件是3.5塊，不管是對報關行業或承攬業，我們就俗稱是報關的業者，每一件3.5塊就轉嫁給消費者。第二筆，業者溯源的確認費，我們希望在發貨的時候……包括亞馬遜或者國外的網路平臺，其實跟關貿網路公司的API都已經介接了，這些報稅業者或承攬業者如果要使用溯源的服務費，每個月都要繳給關貿公司2,500元，以後要確認的每一筆再加收每件0.8塊。 |

所以有兩筆，一筆是確認費，購買之後要跟報稅相關業者收一筆確認費。另一筆是API的溯源服務費，服務費又分兩筆，一個是每個月給關貿公司2,500元；另外是確認費，只要有經過這邊服務的每一筆再加0.8塊。哇！這些全部都轉嫁給所有消費者，你知道這量體有多大嗎？署長，你應該知道每一年……今年2026，請問2025年我們透過網購報關有多少件？ |

林委員岱樺：算6,000萬啦，甚至曾經有高達1億件喔。所以幾乎……不管6,000萬或是我了解的高達1億件的紀錄，不管，就用6,000萬就好，你知道剛才那些轉嫁費用，幾乎每一個業者大概一個月都要送給關貿公司一臺Benz，這些費用都是誰繳？都是這些業者繳？不是，都是所有的消費者繳！這樣你還認定關貿網路公司的EZ WAY業務不是官方法定的通關嗎？署長，你還說不是嗎？這些費用它可以這樣亂收嗎？所以我強力要求政府把這個權力收回，正式編預算。你憑什麼將科技進步帶來的通關便利外包給關貿公司，而關貿公司可以這樣……我收的費用我自己訂，全部轉嫁給業者，你還用公權力修法咧，你修的法可多了，你修了所有的通關細則、修了航運及空運兩個法的快遞相關辦法，還修了海關稅則相關，這樣還不是公權力？署長你認不認同？ |
