伍麗華Saidhai Tahovecahe委員：次長好。前面兩位委員同樣都有提到你們宣布公幼辦理延長照顧服務作業要點有新的辦法上路，大家就會接到很多的陳情，因為剛才前面你們都有答復，我就直接講。我們都很了解學校的環境，你有這個辦法出來，雖然沒有強迫實施，但是家長就會覺得，既然有這個辦法可以用，他一定會要求，他也一定會要用到，這是人之常情，加上學校也沒有辦法拒絕，很多的地方又調度不到人力之下，您也知道，很多偏鄉公立幼兒園就那麼幾位，也許就2位、3位，所以這個會變成讓他們很恐慌的一件事情，所以我想了解一下，我們實施這個新制是來自於什麼樣的原因？ |

伍麗華Saidhai Tahovecahe委員：而且只要有一個家長提出需求，就算只有一個小朋友，都必須要有老師留下來。我覺得老師也不是不願意留下來，而是我們都很清楚知道，其實幼兒園的教師、國小的教師很多都是不到7點就到校，幾乎都是如此，只要有學生進來，老師就要在，因為要開門、要陪伴。現在這樣子門一開，大家都一定會碰到這樣的狀況，只要有一位家長提出要求，他們就要留到7點，然後找不到人，學校也很困擾，這個該怎麼辦？我的意思是，要趕快想配套措施。 |

彭署長富源：謝謝委員。對於委員剛才幾個問題，剛好我最近有到都會地區以及復興鄉去了解這個情況，我把這整體狀況讓委員也知道一下。基本上都會地區可能很多是雙薪家庭，當雙親都去工作的時候，的確會有這方面的需求，這樣的園在工作的時候，他不是只有原來的幼教工作者，他可以是延托的符合資格者，所以是額外的人力，不是原來教學者而已。另外，我去抽一些比較偏鄉地區的，實務上我請教幾位校長，這個會不會造成他的壓力？有一些地方基本上是沒有這個需求，沒有這個需求的，他也不會開辦，他也沒有符合相關的、一定的要求規範。我查一查，地方政府也不會訂，所以從中央、地方都不會有強制要求的情況下，委員擔心的一些問題，倒滿自然的是依需求。此外，會不會因為有一個家長特別要求，以至於原來不用辦的卻要辦等等，這個可能是相關的縣市政府跟地方的學校在協調的過程中，如果有類似的案子，我們會積極地了解實際的情況，來輔以相關法規的協助。 |

伍麗華Saidhai Tahovecahe委員：最後，我想時間也到了，我只是要表達，我不太想說校事會議，因為講這四個字有點太沉重，而且已經變成一個形容詞了。關於教師解聘不續聘停聘或資遣辦法，我想我們都已經知道，整個會期都在關注這件事，事實上上一次也已經做退回更正了，可是教育部還有一個承諾，就是9月你們會端出新的辦法。因為這是本會期的最後一次質詢，9月也要到了，我只是想要讓次長、署長了解，其實我們自己接到這樣的案件真不少。上個禮拜六，你看一下這個，他之前不斷地跟我對話，我一直不願意拿出來講，這是我跟他陸陸續續的對話，我一直在給他加油打氣，我們也不願意拿這種事情好像變成了要去開記者會或者是要去賺流量等等，我們也不願意。我輔導他兩年多，禮拜六晚上他輕生了，我非常地難過，我從來沒有因為接到很多的陳情，就特別的只是喊口號，我們想的只是一件事情，就是要怎麼樣透過這個辦法可以沒有學生的憾事、沒有老師的憾事發生，我們希望它能夠變成一個保護老師也保護學生的法令。這個老師很辛苦，兩年多來，他因為被停聘，他好不容易努力10年考上了教職，我也不願意去表示什麼，我只是希望他找個律師陪伴他，因為他即便勝訴了，又再次被開始調查，他覺得他不願意再第二次面對這樣的事情，這個壓力很大，他有房貸、有車貸、有經濟的壓力，最後他承受不住就走了。所以我在這邊只是想要請教，我們如何讓這部法變成一個能夠保護老師、保護學生的法令？請次長說明一下。 |

張廖次長萬堅：立法院再退回叫我們再重新思考之後，其實我們在1月的時候已經做一個初步大小案的分流，現在大家比較在意的是，大案的部分一定要涉及到解聘那個程度，我們判斷後才會進入校事會議去調查。其實我們在第一次分流之後，案件量已經明顯變少了，現在就是小案進入考核的部分，當時的考核辦法裡面是有提到，若有些學校的行政能力不足，調查可以委外，時間可以再延後，這部分我們也在檢討。另外還有一個老師比較希望能夠具體了解的是，他們合理管教的範圍到底界定在什麼地方、誰來認定？這部分我們也在思考怎麼樣讓學校能夠有一些空間去認定之後，再來決定受理跟不受理，這樣可以避免有些主觀的認定上面，會讓家長不斷地跟老師處於這種對峙的狀態。如果學校的認定我們可以尊重的話，譬如說，如果按照學校的認定那是一個合理的管教行為，基本上就不受理，不受理之後，如果家長還有意見的話，我們就另外再開一個管道、方式來處理，這樣子可能會達到……我們目前是在研議中。 |
