今天我先請教次長，還有幾位各部會的代表。網路科技一直在往前跑，至於兒少的保護，我們似乎一直跟在後面，當然跟過去的時代比較的話，其實都是在進步。今天涉及到整個性侵害犯罪防治法跟兒少剝削，其實也不只是衛福部的事情，那是牽扯到兒少的保護，涉及到整個犯罪的偵查，甚至涉及到NCC、數發部，對於安全，要怎麼分級、要怎麼審查，這也是大家都有責任的。我今天其實只有三件事要問，我剛剛很仔細地在臺下聽，我反而認為，第一個就是像我們今天在聯席裡面審查這樣的法案，本席……本來我不是想問這一些，可是聽完以後，我還是覺得要把題目變更一下，我簡單寫了幾個題目，就是就網路性影像，我們這樣在審條例，到底有沒有辦法抓得到？這是第一個。第二個是現在網路上面一鍵式脫衣的高風險AI，我們到底是不是管得到？當然最後面就是孩子受害以後，政府是不是接得住？這當然就是衛福部可能必須要好好去思考的問題。政府現在用AI去抓性影像部分，是不是抓得到？以前都是被檢舉之後，我們再去處理，現在不是，你看在113年的時候，因應社會矚目案件，為了加強兒少保護，立法院也三讀通過兒少性剝削防制條例。 |

莊委員瑞雄：以前這全部都是由檢察官去判定有沒有妨害風化的問題啊，但現在涉及到的已經不是這個問題了！好，你說明年要上線，為什麼要等到明年？113年就通過了要主動巡查，這不簡單喔，主動巡查的部分，我怎麼想也沒想到主動巡查會變成衛福部的工作，那是因為牽扯到兒少，不然我一直在想這個為什麼是衛福部負責，刑事警察局平常也在查，當然，你說法務部叫檢察官去查這個，他哪有人力？檢察官辦案就是在分層節制底下去做犯罪偵查，他們有分工嘛，但是會把這個丟到衛福部，當然就是希望你們盡更大一點的責任，但問題是你們做得到嗎？ |

莊委員瑞雄：AI有夠方便的，方便到現在要犯罪的人只要有這個app，我先到社群裡面，你們任何人只要有社群且在社群上有放照片的，我都可以把照片抓下來，一抓下來，app一弄上去以後，一按下去衣服、褲子都脫光光了，一鍵脫衣馬上就生成，AI這麼進步，到最後其實不只脫衣而已，可能還兼做色情影片，這很麻煩啊！以成年人來講當然會提告，還會有一些作為來主動保護自己，但對兒少來講的話，他什麼事情都沒有做，這些影像就在網路上流竄了，對他整個未來或他整個人際關係造成非常大非常大的影響。現在法律可以去處罰製作跟散布，但我覺得最主要的是，政府對於這些平臺部分的對策是什麼？要怎麼去給它們加重？次長是否可以簡單說明一下，你們準備要怎麼管？ |

黃副署長雅萍：跟委員報告，我大概從幾個層面來講，誠如剛剛次長提到的，有關於風險分類、分級的部分，其實數發部跟衛福部已經一起在做這個部分的討論，未來衛福部也會將相關可能涉及到一鍵脫衣這樣的一個題目給我們，我們會就市面上大家常用的一些AI模型去檢測，這些檢測報告出來也會公布給大家知道，這是第一個。 |

第二個，剛剛委員垂詢到網路廣告平臺如果有這樣一個情況的時候應該怎麼處理，當然，在事後我們只要有發現，我們就可以讓TWNIC去做封網的動作，或者是停止解析這個網頁，但是我們也有透過……因為之前防詐本來就有一個聯防平臺，針對這些比較大型的平臺業者，我們也會要求他們要先自律，所以其實他們自己本身也會去做事前的網路掃描，如果發現有這樣的狀況，他們就會提早做下架的處理，這個部分跟委員先做個補充。 |
