首先，針對醫療暴力加強防治的部分，這幾年來，無論是在新聞媒體，或者在醫療第一線實務上，醫療暴力從未間斷，平均一年超過三百件妨害醫療事務的案件，急診室更是首當其衝，過去的罰鍰只有3到5萬元，嚇阻力明顯不足，因此在這次修法，我們將罰鍰提高到5萬元到25萬元，並新增公然侮辱醫事人員可處2年以下有期徒刑，並得併科20萬元以下罰金，更明定警察機關在接獲通報後，應該要立即到場排除或制止。 |

王委員正旭：（9時47分）主席、各位同仁，大家好。今天醫療法部分條文修正案三讀通過，身為衛環委員會的委員，也是提案人之一，我要特別感謝衛環委員會各黨團的委員、衛福部以及醫界共同努力，讓這部法案可以透過協商達成共識，在今天順利三讀通過。 |

這次醫療法的修正通過，特別是在加強防治醫療暴力，以及開放法人擔任醫療社團法人社員，並給予合理監管的部分，其實代表著我們國家與政府對第一線醫事人員的明確承諾，提供第一線醫事人員具體需要的法律後盾與保障，讓所有的醫事從業人員能夠安心執業，也讓醫療體系能夠走得更長遠。 |

首先，針對醫療暴力加強防治的部分，這幾年來，無論是在新聞媒體，或者在醫療第一線實務上，醫療暴力從未間斷，平均一年超過三百件妨害醫療事務的案件，急診室更是首當其衝，過去的罰鍰只有3到5萬元，嚇阻力明顯不足，因此在這次修法，我們將罰鍰提高到5萬元到25萬元，並新增公然侮辱醫事人員可處2年以下有期徒刑，並得併科20萬元以下罰金，更明定警察機關在接獲通報後，應該要立即到場排除或制止。透過這些修正，我們希望讓醫事人員能有更安全、更穩定的工作環境，不用在一邊救人的時候，還要一邊擔心自己的安全。 |

再來，針對開放法人擔任醫療社團法人社員的部分，主要是考量為了因應目前社團法人部分社員老化、資金缺口、設備更新困難，單靠自然人社員出資難以支撐長期發展的問題。但同時我們也了解，對於開放法人參與，不管是在主管機關、監管上、社會從醫療法人維持專業性跟公益性的角度，都還需要平衡。 |

因此，我們特別要針對開放法人的社員資格設有限制，並且針對每一個社員就財產權利處分、轉讓時，都要得到適當的許可，並且提高盈餘提撥比例專用款用於改善醫事人員勞動條件跟醫療品質。透過以上這些設計，我們希望社團法人醫院在引進資金的同時，也能夠維持社團法人的專業性跟公益性。 |

最後針對這次醫療法，包括醫事人員的權利保障，或者是整體的醫療環境，都還有能夠更進步的地方，因此，未來我在立法院還會持續努力，透過修法、質詢、預算提案，改善我國的醫療環境，照顧全體國人的健康，謝謝。 |
